The Court of Appeal in Abuja has deferred judgment in an appeal lodged by Nasarawa State Governor, Abdullahi Sule of the All Progressives Congress (APC), challenging the tribunal’s majority decision that nullified his election in favor of David Ombugadu, the candidate of the Peoples Democratic Party (PDP).
A three-member panel of justices presided over by Justice Uchechukwu Onyemenam informed the involved parties that the date for judgment would be communicated.
During the day’s proceedings, Wole Olanipekun, the counsel to Governor Sule, who submitted five processes to contest the appeal, urged the court to dismiss the tribunal’s judgment and uphold his client’s appeal.
Olanipekun argued that the tribunal failed to consider the submissions of their witnesses during the hearing and that the data from the Bimodal Voters Accreditation System (BVAS) presented to the tribunal were merely dumped without being regarded as evidence.
Following the adoption of his processes, Kanu Agabi, the counsel to Ombugadu and the PDP, urged the court to reject the appeal against the tribunal’s judgment, stating that their evidence was primarily documentary.
On the BVAS issue, Agabi argued that it was adequately demonstrated in the tribunal, with the printout from the machine shown, contrary to the assertion that they were merely dumped without analysis.
Agabi directed the court to the tribunal’s judgment, emphasizing that it meticulously outlined how it arrived at its decision.
